The petitioner is aggrieved by the fact that in spite of a case being Pathar Pratima Police Station Case No. 08 of 2025 is pending against the private respondents, the private respondents are pursuing their illegal activities not only in threatening but also are adamant in causing physical harm to him. To that effect, the private respondents have threatened the petitioner for withdrawal of the case also.

I find that already a case being

Pathar Pratima Police Station Case No. 8 of 2025 is pending. An information dated 05.03.2025 addressed to the Officer-incharge of Pathar Pratima Police Station incorporates the previous incidents except the incident dated 03.03.2025. So far as the incident dated 03.03.2025 is concerned, the petitioner would bring the same to the notice of the learned ACJM, Kakdwip. The learned ACJM, Kakdwip, would conduct an enquiry and after enquiry, if he/she finds any genuinity in the accusations so made in the information furnished to the police authorities, would direct the police authorities to act by way of whether any cognizable offence has been made out and to that effect direct for addition of Section and/or for registration of any other case.

The petitioner would also be at liberty to pray for protection under the Witness Protection Scheme, 2018 before

the learned ACJM, Kakdwip. The learned ACJM, Kakdwip would assess and call for a threat perception report in view of the fact that petitioner happens to be a witness in the case and pass necessary direction(s) under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 5753 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
