Learned advocate appearing for the petitioner has submitted that the proceeding being Complaint Case No.C 1419 of 2017 is unnecessarily being stretched at the instance of the accused before the learned ACJM, Baruipur, 24 Parganas (South). The said proceeding is under Section 138 of the Negotiable Instruments Act.
Learned advocate submits that on eight occasions defence took time for production of defence witness. Having regard to the contentions so advanced, I direct the learned Magistrate on and from the next date, another three months be granted opportunity to the defence to produce its witness in the month of July, 2024 dates be fixed for arguments of the case and the learned trial court thereafter will take efforts so that by 31st August, 2024 the final verdict of the case is pronounced. With the aforesaid observations, the revisional application being CRR 938 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
