A higher scale of pay was re-fixed in favour of the petitioner and in consequence thereof, the petitioner is entitled to a sum of Rs.7,19,120/- (Rupees seven lakh nineteen thousand one hundred twenty) towards arrear salary but the same was not paid.

Mr. Saha, learned Counsel for the State submits that the said arrear salary after deduction of admissible TDS has been paid to the petitioner. Mr. Jaydip Basu, learned advocate for the petitioner submits that the arrear salary was payable long back, as such the petitioner is entitled to interest on the said amount of arrear salary.

The petitioner lodged a formal claim to get the said money on November 15, 2019, therefore the concerned authorities are directed to pay interest on the said amount of arrear salary @ 8% per annum from the aforesaid date till the date of payment.

W.P.A. 5839 of 2023 is disposed of with the above terms without any order as to costs.
