The Chief Secretary, Government of West Bengal and others (Through Video Conference) Mr. Gangadhar Das, Mr. Swarvanu Saha, Mr. Tanmoy Chattopadhyay, Advocates ....for the petitioners Mr. Jaharlal Dey, Mr. Sudip Sarkar, Advocates ... for the State The grievance raised by the petitioners is in respect of various irregularities, illegalities and defalcations in implementation of the MGNREGA in the Gazole Development Block.

Learned counsel for the petitioners has referred to the allegations which have been made in the complaint dated 18.08.2020 and 02.11.2020 as also the legal notice dated 14.01.2021 and has submitted that there is an embezzlement of huge public money, but no action has been taken in spite of the complaint.

Having regard to the nature of allegation, we are of the opinion that the respondent No.6, District Magistrate, Malda should look into the matter. Hence, we dispose of the present petition with direction to the respondent No.6 to conduct an enquiry in respect of the allegations contained in legal notice dated 14.01.2021 and if the allegations are found to be correct, then to take an action against the erring officers/parties in accordance with law.

WPA (P) 91 of 2021 The petitioners are permitted to submit all the material available with them to the District Magistrate, Malda in respect of the allegations.

Let this exercise be completed as expeditiously as possible preferably within a period of 3 months from the date of receipt of the certified copy of this order. The present petition is accordingly disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
