(DL) (DL) 28.03.2025 28.03.2025 Ct. No. 18 (ARPAN) W.P.A. 5791 of 2025 Rita Nandi alias Rita Rani Nandi Vs.

The State of West Bengal & Ors.

Mr. P.D. Mukherjee Mr. Ayush Shaw Ms. Bristi Chandra ...for the Petitioner Mr. Supriyo Chattopadhyay, AGP Ms. Sayantanee Bhattacharjee ...for the State Mr. Sourav Kumar Dutta ...for Respondent No.8 Mr. Subham Dutta ...for Respondent No.9 Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner is claiming to be the first wife of respondent no.8 and the grievance of the petitioner is after retirement of respondent no.8 he is getting pension but in the pension documents petitioner's name has not been inserted as nominee whereas name of another lady has been inserted and declared as wife of respondent no.8. No marriage certificate is enclosed to this writ petition based on which grievance of the petitioner can be examined.

It appears that it is an issue where petitioner is claiming to be the wife of respondent no.8 whereas respondent no.8 has already declared another lady as his wife and nominee in the connected service records. Therefore, no relief can be granted to the petitioner on this writ petition.

However, this order shall not preclude the petitioner to approach the Civil Court seeking an appropriate declaration.

With the above observation, writ petition stands dismissed.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
