Petitioner approached this Court because of inaction on the representation and/or information furnished with the Rejinagar Police Station.

Learned advocate for the State has submitted a report. Report reflects that a civil case is pending before the learned Civil Judge (Senior Division), Berhampore, Murshidabad being Partition Suit Case No.391 of 2023. According to the State, there is a dispute amongst the co-sharers of the property. Learned advocate for the respondent nos.5, 6 and 8 is present and adopts the submission made on behalf of the State that a civil dispute has been given the cloak of a criminal proceeding, as such, police authorities did not act. Report reflects that at the relevant point of time police authorities drew up proceedings under Sections 107/116 of Cr.P.C.

Having considered that the police authorities are well aware regarding the inimical relationship, if the situation so demands and informations are received, police authorities would continue their surveillance.

With the aforesaid observations, WPA 6166 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
