The petitioner has preferred the instant application with a prayer for quashment of the Special case no. 1 of 2008, presently pending before the learned Additional Sessions Judge, 2nd Court, Hooghly.

During the course of hearing, learned counsel for the petitioner submits that the evidence of the prosecution has been completed and 2nd March, 2026 is fixed for examination of the accused person under Section 313 of the Code of Criminal Procedure. He further submits that in spite of earlier directions made by this High Court twice, the proceeding has not yet been concluded.

In view of above background, I find that the case is pending since 2005 and a direction is required to be passed for expeditious disposal of the instant proceeding.

In such view of the matter, the instant application being CRR 1163 of 2025 is hereby disposed of by giving direction upon the court below to conclude the examination of the accused person under Section 313 of the Code of Criminal Procedure on the date fixed i.e. on 2nd March, 2026 or within a week thereafter and after examination of the accused person, the court below will conclude the trial following next procedure and will deliver judgment preferably within a period of 60 days thereafter.

This order is passed invoking this court's jurisdiction under Section 483 of the Code of Criminal Procedure read with Section 529 of the BNSS.

Liberty is given to the petitioner to prefer further application before this court in case of non-compliance of the order.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
