Galib, ... for the Board of Aquaf The grievance of the petitioners arises from a Notification dated 28th January, 2022 published by the State Minority Affairs & Madrasah Education Department, by which two members were nominated to the Board of Aquaf. The petitioners are aggrieved by the 2nd nomination on the ground that the said nominated member does not fulfil the criteria laid down under Section 14(1)(d) of The Wakf Act, 1995.

The representations made by the petitioners on 14th February, 2022 and 22nd February, 2022, have also not been responded to, by the Secretary of the concerned Department.

The Auqaf Board is represented.

After hearing learned counsel, this Court is of the view that the writ petition can be disposed of with a direction on the respondent no. 1 being the Secretary, Ministry of Minority Affairs & Madrasah Education Department, to consider the representations made by the petitioners and dispose of the same by passing a reasoned order within a period of three weeks from the date of communication of this order, after hearing all the necessary parties including the petitioners. A copy of the reasoned order shall be made available to the petitioners within a week from the date of passing such order.

WPA 5493 of 2022 is disposed of in terms of the above.
