P.P., Mr. Imran Ali, Ms. Debjani Sahu ...for the State The learned counsel appearing on behalf of the petitioner, namely, Chanchal Roy, submits that the said petitioner has been acquitted from the charge under Section 20 of the NDPS Act in connection with Tapan PS Case No. 385/2016 dated 25.11.2016.
The learned Additional Public Prosecutor furnishes a copy of the said judgement passed by the Additional District & Sessions Judge, 3rd Court (Spl.) under NDPS Act at Balurghat, Dakishin Dinajpur in connection with Special Case No. 16 of 2018 arising out of Tapan PS Case No. 385 of 2016 dated 25.11.2016.
From the copy of such judgement it reveals that the accused in the said NDPS case who is the petitioner in the instant criminal revision has been found to be not guilty of the charge under Section 20 of the NDPS Act
and as such he has been acquitted from the said case in terms of Section 235 of the Code of Criminal Procedure. Considering the aforesaid fact of acquittal, the instant criminal revision is not required to be proceeded with.
Hence, the instant criminal revision is disposed of. Let a copy of the judgement of the learned Trial Court be kept with the record.
