The petitioner is a TET qualified candidate. He participated in the recruitment process initiated by the Board in the year 2016. It appears from the instructions given by the West Bengal Board of Primary Education that he was called for scrutiny/verification in 2016 as an untrained candidate. His score being less than the score of the last empanelled candidate in his category he was not empanelled in 2016-2017.

The petitioner thereafter again applied in response to the recruitment notification published by the Board in the year 2020 as a trained candidate. He was called for scrutiny and verification. His name could not be included in the State wide merit list as he scored marks less than the last empanelled candidate in his category. The score obtained by the petitioner is 24.949 and the score obtained by the last empanelled candidate in his category is 28.330. From the instruction that has been received from the Board, it appears that the petitioner could not be empanelled as he did not score marks more than the last empanelled candidate.

In view of the above, no relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Instruction given by the Board to the learned advocate be retained with the record.
