(Through Video Conference) Mr. Jahar Lal De, Ms. Smita Das De ..for the State This writ petition was filed in the year 2018 with a prayer to restrain the official respondents from granting permit for extraction of sand from the bank of river Damodar and agricultural lands situated by the side of river Damodar within Mouza Sheet Nos.2, 4 and 5 of Mouza Gohagram within PS Galsi in the District of Purba Bardhaman.

Learned counsel for the State has produced the report at the instance of the Officer-in-Charge, Galsi Police Station dated 19th of June, 2018 which mentions that the lease holder of one Sand Block in Gohogram Mouza under PS Galsi, District Purba Bardhaman was one Radha Bhattad of Radhakrishna Pally, Benachity, Durgapur, Burdwan, but he has not been impleaded as party. The report further submits that the challan for transportation of sand was also issued and that the Sand Block was under closure because of the agitation of the villagers.

More than three years have passed thereafter and the petitioners are not present to prosecute this petition and it is not known if the grievance of the petitioner still survives.

Hence, we dispose of the petition by granting liberty to the petitioners to file an appropriate representation before the respondent no.3/District Land and Land Reforms Officer, Purba Burdwan, if they have any surviving grievance. If any such representation is filed, the respondent no.3 will duly consider and examine the grievance of the petitioners expeditiously. The petition is accordingly disposed of.
