Sri Tribhuban Prasad Singh Mr. Gopal Ch. Ghosh, Mr. Rajkrishna Mondal ...for the petitioners A direction to secure expeditious disposal of interlocutory applications, filed by the plaintiffs/petitioners, is the only relief sought for in this case.

Mr. Ghosh, learned advocate appearing for the petitioners submits that issues have not yet been framed even after disposal of petition under Section 7(2) of the W.B.P.T. Act.

It is contended by the learned advocate for the petitioners that since the opposite party/defendant has committed departure in ensuring compliance of the order passed under Section 7(2) of the W.B.P.T. Act, a separate petition under Section 7(3) of the W.B.P.T. Act has been filed by the plaintiffs coupled with the prayer for local inspection under Order 39 Rule 7 C.P.C. The hearing of those two interlocutory applications is getting delayed without any just reasons.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary. Service of notice upon the opposite party is thus dispensed with.

Accordingly, learned Civil Judge (Senior Division), 9th Court, at Alipore, in Ejectment Suit No.118 of 2016, is requested to ensure expeditious disposal of pending interlocutory applications, filed by the petitioners/plaintiffs, providing sufficient opportunity of hearing to either of the parties to this case, but without any unnecessary adjournment, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the opposite party and his learned advocate appearing in the court below as well as the learned court below.

With this direction/observation, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
