The petitioner seeks intra-district transfer on medical condition of his son from Domkal South Circle to Sargachi Circle in the District of Murshidabad.

The DPSC, Murshidabad has obtained medical opinion from the CMOH, Domkal which indicates that the petitioner's son's medical condition is genuine.

In those circumstances, the DPSC, Murshidabad shall take a decision on the transfer of the petitioner in the matter to the chosen school or any nearby school subject to availability, within a period of one month from date.

If the medical condition of the petitioner's son was existing as such on the date of petitioner's entry into service, the application shall not be treated as under special conditions.

Let the aforesaid process be conducted by the parties offline.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

8.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
