Criminal Revisional Jurisdiction 05-03-2024 Subha Item no. 40 Ct no.34 CRR 935 of 2024 Smt. Sarmistha Das -versus- Shri Atanu Das Mr. Pawan Kumar Gupta Mr. Biswarup Paine .....for the petitioner.

Petitioner is aggrieved by the progress of Misc. Case No. 2063 of 2018 which is pending before the learned Judicial Magistrate, 4th court, Serampore, Hooghly.

According to the petitioner the case is pending for more than five years and there has been no progress in the case as in a designed manner the opposite party has been dealing the proceedings. Till date, the affidavit of assets and liabilities of the opposite party no.2 has not been filed and on such plea dates are being taken before the learned trial court. Learned Magistrate would insist that the issue relating to affidavit of assets and liabilities be completed on the next date so fixed or within a fortnight thereafter. The learned trial court would thereafter fix at least one date in every forty-five days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

It is reiterated that both the parties would complete filing of

the affidavit of assets and liabilities afresh by the next date so fixed or within a fortnight thereafter, but the learned Magistrate will not stretch the timeline so fixed by this court.

With the above observations, the present revisional application being CRR 935 of 2024 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
