The revisional application was preferred challenging the proceeding arising out of Rejinagar police station case no. 154 of 2011 under section 468/471 of IPC.

On conclusion of investigation charge sheet has been filed and the report submitted by the Officer in Charge Rejinagar Police Station reflects that the case is fixed for recording of evidence on 23.11.2021.

Having regard to the fact that there has been change of circumstance since initiation of the proceeding and the case has proceeded to the stage of the evidence, I am of the view that no interference can be made at this stage in respect of contention advanced in the revisional application. However the petitioner will be at liberty to canvass the point contended in the revisional application at the appropriate stage of the proceeding. With the aforesaid observations, CRR 747 of 2012 is disposed of.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this court.
