(DB) 930 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Shyampur Police Station Case No. 337 of 2022 dated 31.07.2022 under Sections 320/201 of the Indian Penal Code.

Report submitted by the State is taken on record. Bail prayer of the petitioner was turned down by this Court earlier considering the merits of the case. The petitioner seeks bail on medical ground.

Heard learned counsels for the parties.

It appears from the report that the petitioner is currently admitted in Kolkata Police Hospital and is stated to be haemodynamically stable. The report further indicates that his treatment can be continued at SSKM Hospital, Presidency Correctional Home Ward after his discharge from the police hospital.

Since it appears that the petitioner is being adequately looking after and treated in custody, his release on bail on medical grounds does not arise.

The prayer for bail is accordingly rejected at this stage.

The Superintendent of the concerned correctional home is directed to render necessary medical assistance to the petitioner as and when required.

The application is disposed of.
