December 14, 2022 Sri Basudeb Dey Vs, Smt. Anju Bishnu The matter appeared in the warning list on November 29, 2022 with a clear indication that the matter would be transferred to the daily cause list on December 5, 2022 before the regular bench. Since then the matter is appearing in the list. The present appeal is of the year 2007.

Today the appellant is not represented, nor any accommodation is prayed for.

It appears from the record that a co-ordinate bench on October 9, 2012 directed the matter to be listed for final order in the event the defects pointed out by the stamp reporter was not removed. On that date none had also appeared. The learned advocate for the appellant did not take any step for removal of the defects as pointed out by the stamp reporter and as directed by the co-ordinate bench in its order dated October 9, 2012. Under such circumstances, the appeal stands dismissed for non-compliance of the order dated October 9, 2012. In view of dismissal of the appeal, the connected application filed under 3323 of 2007 also stands dismissed. There will be no order as to costs.
