Mullick ... for the Petitioner(s) Mr. Anupam Das Adhikari Mr. Parvej Anam ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for three years nine months and, till date, out of the 14 witnesses cited in the charge-sheet, only two witnesses have been examined.

Learned advocate for the State opposes the prayer for bail and submits that three witnesses including the victim have been examined by the prosecution.

The merits of the case reflect that the offence was committed in a heinous manner.

Having regard to the period of detention of the present petitioner and the fact that the victim has already been examined by the court, without entering into the

merits of the case but only on the ground of period of detention, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Moinul Sardar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional District Judge, Fast Track Court, Baruipur.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of 24 Parganas (South) without prior intimation to the learned trial court.

Accordingly, CRM(M) 668 of 2026 is allowed.
