For WBUHS The writ petitioner is a student of the ICARE Institute of Medical Sciences and Research and seeks to migrate to a Government Medical College. According to learned counsel appearing for the petitioner, the petitioner has complied with most of the requirements for migration but complains of inaction on the part of the West Bengal University of Health Sciences in providing the requisite information as to the Medical Colleges under the State which have the vacancies.

Learned counsel appearing for the National Medical Commission submits that the 1997 Regulations, as amended, do not require the National Medical Commission to process any

information since the migration sought for in the present case is within the State.

Learned counsel appearing for the West Bengal University of Health Sciences submits that the process may be different. It is also submitted that IPGME&R has already indicated that it does not have any vacancies.

After hearing learned counsel, this Court is of the view that the writ petition may be disposed of with a direction on the State authorities to provide the information of existing vacancies in such Medical Colleges to the petitioner within a period of two weeks from date. The petitioner shall thereafter be at liberty of taking further steps in aid of the migration sought for.

The petitioner shall be at liberty of collecting the information from the office of the Directorate of the Medical Education after two weeks from today.

WPA 5534 of 2022 is disposed of in terms of the above.
