I have considered the orders passed by the ld. ACJM, Durgapur and I do not find any illegality in the order, as by an order dated 5.3.2024, the ld. Magistrate directed that in case the defacto-complainant intends to examine herself as a witness in future, she would be at liberty on any date so fixed by the court to get herself examined.

In view of the observations of the ld. ACJM, Durgapur in connection with G.R. Case No. 1128 of 2022 arising out of Faridpur P.S. Case No. 59 of 2022 dated 24.6.2022, I direct that, in case, the petitioner who has approached this court, namely, Pratima Chatterjee, files an application for examining herself in connection with the instant case, she may be examined as was earlier directed in the order dated 5.3.2024.

With the aforesaid observations, CRR 947 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
