Act and Section4(i) of the M.M. Act.

And In the matter of: Somnath Bauri @ Somenath Bouri @ Rathin Bauri & anr.

...... petitioners Mr. Pinak Kr. Mitra, Ariba Shahab ....for the petitioners Mr. Saryati Datta ...for the State There are number of criminal cases pending as against both the petitioners relating to Mines and Minerals Development and Regulation Act as also Coal Mines Nationalization Act.

There are materials in the case diary implicating both the petitioners in the offence alleged.

Considering the gravity of the offence and the involvement of the petitioners in the incident we are unable to grant anticipatory bail to the petitioners.

CRM (A) 1071 of 2023 is rejected.
