Mr. Kishore Dutta Ms. Anuradha Poddar ....for the petitioner After the death of the father of the petitioner on 5th January, 1990 who was working as Group-D staff of Shri Sanatan Dharma Vidyalaya, Kolkata (hereinafter referred to as "said school") the petitioner being son of deceased nonteaching staff was allowed to work as Group-D staff with effect from 1st August, 2004 in the said school. It has been submitted by Mr. Kishore Dutta, learned senior advocate representing the petitioner that after being appointed to work as Group-D staff of the said school on 1st August, 2004 till date petitioner has been discharging duty. On 25th January, 2019 petitioner made prayer to the teacher-in-charge of the said school for consideration of his engagement on permanent basis. The grievance which has been voiced in this writ petition is till such approach has been made by the petitioner to the teacher-in-charge of the said school the issue remains pending.

It has also been submitted on behalf of the petitioner that school authority on 1st February, 2019 has forwarded the relevant documents relating to the service of the

petitioner to the office of the respondent no. 3 for due consideration.

However, no one is representing the Staterespondents as well as school authority today. In view of aforesaid facts, this Court grants leave to the petitioner to make comprehensive representation to the District Inspector of Schools (SE), Kolkata within a period of fortnight from this date claiming approval of his engagement as Group-D staff in the said school. If such representation is made within the aforesaid time the respondent no. 3 in his turn shall take decision in accordance with law after giving opportunity of hearing to the petitioner as well as the said school authority within a period of 12 (twelve) weeks from the date of receipt of such representation and the reasoned decision to be communicated to the petitioner within 2 (two) weeks thereafter.

With the aforesaid direction, the writ petition stands disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
