Bijoy Karmakar v. Ashok Karmakar & ORS
18.04. 2022 item No.47 n.b.
ct. no. 34 CRR 441 of 2013 Bijoy Karmakar Vs.
Ashok Karmakar & Ors.
Mr. Apurba Kumar Datta .....for the Petitioner The present revisional application was preferred challenging the order dated 29.1.2013 passed by the learned SubDivisional Executive Magistrate, Asannol in M.P. Case No. 81 of 2013.
Having regard to the fact that the prayers advanced were for a limited period of time under the statute, I am of the opinion that the proceedings before the Learned Executive Magistrate has become infructuous.
As such, CRR 441 of 2013 is dismissed as infructuous. Pending application, if any, consequently disposed of. However, it is directed that the learned Sub-Divisional Executive Magistrate should not proceed with the case being M.P. Case 81 of 2013 and consider the same to be quashed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
