The subject matter of the revisional application relates to order dated 19.11.2012 passed by the learned Executive Magistrate, Alipore in M.P. Case No.5765 of 2012 under Section 144(2) of the Code of Criminal Procedure.

Having regard to the nature of the proceedings and the statutory period required for invoking the provisions of Section 144(2) of the Code of Criminal Procedure, I am of the opinion that the proceedings before the learned Executive Magistrate has become infructuous.

Accordingly, CRR 442 of 2013 is dismissed.

Pending application, if any, is consequently dismissed. Consequently, M.P. Case No.5765 of 2012 is considered to be quashed.
