Ms. Shebatee Datta .....For the Petitioners Mr. Amit Baran Dash Ms. Subhra Nag .....For the Opposite Party A direction to secure expeditious disposal of a stay application filed in connection with Title Appeal No.13 of 2021 arising out of Title Suit No.64 of 1983 now pending before the Learned Additional District Judge, 1st Court, Howrah is the ultimate relief sought for in this case.

Ms. Shebatee Datta, learned advocate appearing for the petitioners submits that the stay application in connection with the pending appeal was filed on 18th March, 2021, but till date, the same has not been disposed of resulting in serious prejudice to the appellants/Sebaits.

Mr. Amit Baran Dash, learned advocate appearing for the opposite party submits that the stay application may be directed to be disposed of expeditiously providing an opportunity of hearing to the other side.

Accordingly, Learned Additional District Judge, 1st Court, Howrah is requested to ensure expeditious disposal of stay

application filed by the appellants/petitioners, on 18th March, 2021, providing sufficient opportunity of hearing to either of the parties to this case, but without any unnecessary adjournment, unless it extremely unavoidable.

Petitioners are directed to make communication of this order to the learned court below as well as the learned advocate appearing in the court below for the opposite parties. With this direction and observation the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities.
