Mr. Sk. Moinuddin ...for the petitioner This application under Article of the Constitution of India is at the instance of the defendants praying for dismissal of the suit on the ground that the same is a vexatious one.

After going through the order sheets appended to this civil revision application this Court finds that April 7, 2025 has been fixed for hearing on the point of maintainability.

The learned advocate appearing for the petitioner submits that the hearing on the point of maintainability was being adjourned from time to time.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.

Since the hearing on the point of maintainability has been fixed, CO 912 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Div.), 7th Court, Alipore to take up the hearing on the point of maintainability on the next date fixed i.e., on April 7, 2025 and to decide such issue as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
