The Gangasagar Gram Panchayat shall ensure that all the documents relating to the inspection and finding of unauthorized construction are sent to the concerned SubDivisional Officer for necessary steps under Section 23(5) of the West Bengal Panchayat Act, 1973, as already directed in the order of this Court dated January 19, 2023, within two weeks, if not already sent.

It appears that the panchayat authorities have arrived at a conclusion that the construction of both Manas Chatterjee and Srikanta Mondal are unauthorized.

Accordingly, it has been observed that both the constructions deserve to be demolished and for the final action as per law, the matter has been sent to the Sub-Divisional Officer. Needless to mention, the compliance of the order of this court by the authorities, is available. If the petitioner is aggrieved by the observations and the findings, the petitioner's remedy is to challenge the said order. The

adjudication of the correctness of the order is beyond the scope of a contempt proceeding. Upon recording such compliance by the Pradhan, the contempt application is disposed of. The contempt proceeding is dropped. Rule is discharged.

The order passed by the panchayat authority is taken on record.

All the parties are directed to act on the basis of the server copy of this order.
