The writ petitioners claim that the private respondents are encroaching upon their land and they have breached a demarcation.
Counsel for the private respondents submits that the petitioners have approached the SubDivisional Executive Magistrate, Egra by Misc. Case No. 82 of 2020 under Section 145 of the Code of Criminal procedure for demarcation of land.
This Court is of the view that the demarcation of the land is required to be done by the local BL & LRO under the statutory provisions. The petitioners may approach the statutory authority in accordance with law.
Officer-in-charge, Egra Police Station shall, however, ensure that there is absolutely no breach of peace in the area.
With the aforesaid directions, the instant writ petitions shall stand disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
