Kausik CRM (NDPS) 478 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Minakhan Police Station Case No. 400/25 dated 08.08.2025 under section 21(c) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the present case was registered for alleged recovery of 220 bottles of Wincerex Cough Syrup and the present petitioner is in custody for 7 months 22 days.

Learned advocate for the State submits that out of 12 witnesses cited, 7 witnesses have already been examined. Having considered the stage of the trial, I am not inclined to release the petitioner on bail. However, having regard to the quantum of seizure, I direct that if rest of the witnesses are not concluded within a period of 3 months from the next date fixed, learned Trial Court will release the

petitioner on bail on such terms and conditions as it deems fit and proper for ensuring further appearance in course of trial. Accordingly, CRM (NDPS) 478 of 2026 is disposed of with the aforesaid directions.

State is directed to communicate this order to the learned Trial Court.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
