Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated. The petitioner is the brother-in-law of the victim. The brother of the petitioner, that is the husband of the victim, lodged a complaint for restitution of conjugal rights. Thereafter, the police complaint was lodged falsely implicating the petitioner.

Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Criminal Procedure Code.

Considering the fact that the victim names the petitioner as the person involved in the offence under Section 376 of the IPC, we are not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

CRM (A) 1494 of 2022 is dismissed.
