The order proposed to be passed in the present revisional application under Article 227 of the constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present revisional application upon the said opposite party is dispensed with. The petitioner is the plaintiff of the suit for ejectment being Title Suit No. 4 of 2015 pending before the 3rd Court of Learned Civil Judge (Junior Division) at Alipore.

The petitioner is complaining unnecessary delay in disposal of the said suit and prays for a direction upon the learned trial Judge for expeditious disposal of it.

It appears from the record that the witness action in this suit was started on November 20, 2017.

The learned Counsel for the petitioner informs this Court that the evidence from the side of the plaintiff is over and the date has been

fixed for recording the evidence from the side of the defendant.

The Courts are slowly resuming normal functioning during the COVID-19 pandemic period. This Court under such circumstances is not inclined to fix any specific time period for the disposal of the said suit but considering the stage at which the suit has reached, it is expected that the learned Trial Judge shall make all endeavour to dispose of the said suit as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

C.O. 554 of 2021 is, disposed of with the above terms without any order as to costs.

The petitioner is required to communicate this order to the learned Advocate representing the opposite party in the Court below before the next date fixed in the said suit.
