In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A. 4698 of 2020 Smt. Ratna Chatterjee @ Mousumi Chatterjee -versus Dum Dum Municipality & Ors.

Mr. Kishore Mukherjee.

...For the Petitioner.

Mr. Amales Ray, Ms. Mousumi Bhowal, Mr. Aman Gupta.

...For the Municipality.

Affidavit-of-service filed in Court today is taken on record.

The petitioner alleges that her application praying for sanction of the building plan in the premises/holding No. 25, P.K. Guha Road, Ward No. 9 submitted in November 2019 has not been considered by the Dum Dum Municipality till date.

A representation was also made by the petitioner before the Chairman in Council of the Municipality in February 2020. The same is yet to be considered. As it appears that the application of the petitioner praying for sanction of residential building plan is pending consideration at the end of the Dum Dum Municipality, accordingly, the instant writ petition is disposed by directing the Municipality to take a

decision with regard to the application filed by the petitioner for sanction of building plan, strictly in accordance with law, at the earliest but positively within a period of six weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner is directed to forward a copy of the representation dated 5th February, 2020 addressed to the Chairman in Council to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
