Mr. Ambu Bindu Chakraborty ...for the Petitioner In this application, the petitioner has prayed for direction upon the court below for expeditious disposal of an application filed by the petitioner under Section 127 of the Code of Criminal Procedure.

It is submitted on behalf of the petitioner that by an order dated 27.6.2014, the petitioner herein was awarded maintenance of Rs. 5,000/- per month. Since the said amount is insufficient to maintain herself, she filed one application under Section 127 of the Code before the court below on 15.5.2023 for enhancing the said amount of maintenance to the tune of Rs. 35,000/- per month and also Rs. 20,000/- towards litigation cost. The said application is pending for disposal since then, though the opposite party filed written objection long back on 3.7.2024. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is justified in view of its long pendency. Therefore, the instant application being CRR 1156 of 2026 is hereby disposed of with a direction upon the court below to dispose of the petitioner's application filed under Section 127 of the Code preferably within a period of thirty days from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
