Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the present case on false accusations of carrying 2.5 kgs of ganja. Learned advocate submits that the petitioner is in custody for about 120 days and complaint has already been filed by the Customs Authority. Learned advocate for the Customs Authority opposes the prayer for bail and refers to the earlier cases under similar circumstances.

Records of the case reflect that the petitioner is having permanent resident at Kerala. In respect of similar type of offences, I have already held that several cases are detected presently wherein individuals from different States are using the Calcutta

Airport as a corridor for carrying contraband from foreign countries. In such circumstances, whether the contraband is intermediate quantity or commercial quantity is of no relevance. As such, I am not inclined to release the petitioner on bail. Accordingly, CRM(NDPS) 482 of 2026 is rejected. However, liberty is granted to the petitioner to approach this Court if circumstances alter.
