Mr. Abhimanyu Banerjee Mr. Arnab Saha ....for the petitioner Mr. Chandi Charan De, AGP Mr. Haripada Maity ....for the State Leave is granted to the learned advocate on record of the petitioner to file the affidavit of service in course of this day.

The petitioner claims to be the owner of a plot of land within Mouza-Noapara, J.L. No.9 under Police Station Baranagar in the District of North 24 Parganas by virtue of inheritance.

The petitioner states that Refugee Relief and Rehabilitation Department has issued free hold title deeds to several persons in respect of the plot of the petitioner, though the same was not acquired by following due process of law.

The learned advocate appearing for the petitioner draws the attention of the Court to the reply furnished by the concerned authority by a letter dated October 10, 2025 under the provisions of Right to Information Act, 2005 in support of his contention that the said property did not vest to the State. The learned advocate further submits that the petitioner submitted a representation through his

learned advocate's letter dated December 30, 2025 before various authorities including the Sub-Divisional Officer, Barrackpore. He submits that in spite of receipt of such representation, no decision has been communicated by the respondent authorities to the petitioner till date. Mr. De, learned Additional Government Pleader, submits that the decision on the representation shall be communicated to the petitioner within the time limit as may be fixed by this Court.

Without entering into the merits of the claim made by the petitioner in the representation dated December 30, 2025, WPA 5983 of 2026 stands disposed of by directing the Sub-Divisional Officer, Barrackpore, being the respondent No.6 to consider the representation of the petitioner dated December 30, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner and/or any other party and authority, who may be affected by such decision and communicate the reasoned order to the petitioner and others as expeditiously as possible but positively within a period of 12 weeks from the receipt of a server copy of this order along with a copy of the representation dated December 30, 2025.

There will be no order as to costs.
