Mr. Animesh Mukherjee ....for the petitioners This application under Article of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court, Howrah to dispose of Miscellaneous Case No.144 of 2024 arising out of Title Suit No.1262 of 2017 expeditiously.

In view of the order sought and proposed to be passed there is no necessity to issue any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned Trial Judge.

From the order sheets appended to this application, this Court finds that March 7, 2025 was fixed for filing written objection by some of the opposite parties and the petitioner of the miscellaneous case was directed to take fresh steps upon the opposite party No.4 in the miscellaneous case.

Thus it appears that the miscellaneous case is not yet ready for hearing.

CO 920 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court, Howrah to take up the hearing of the Miscellaneous Case No.144 of 2024 after the same is made for hearing and to make an endeavor to see that the same is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
