The petitioner is in custody for more than 8 years and claims parity with the co-accused Abdul Kalim @ Azad @ Abdul Kalam who was granted bail on 8th November, 2024. Opposing the prayer learned counsel for the State submits that the petitioner is not similarly circumstanced with the coaccused since recovery was made from him. Trial is at its fag end. Only the investigating officer is left to be examined. Learned counsel submits that trial shall be concluded within three months from the next date of evidence fixed before the learned trial Court subject to co-operation by the defence and systemic reason. Considering the nature and gravity of the offence and since the trial has progressed sufficiently, prayer for bail is rejected at this stage.
Learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting
any unnecessary adjournment to either of the parties in the light of the submission made on behalf of the State. Case diary be returned.
