Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the manner in which Karaya P.S. Case No. 268 of 2023 is being further investigated pursuant to the direction of the learned CJM, Alipore.

Mr. Ghatak, learned advocate appears for the private respondent nos. 6 to 9.

I have considered the report submitted by the State and the steps which have been taken. Having considered the further investigation being processed and dissatisfaction of the petitioner, I am of the view that the Deputy Commissioner of Police, South East Division will monitor the investigation and if it is of the opinion of the Deputy Commissioner of Police that in course of investigation, certain experts' opinion are to be

obtained, he will use his good office and advise the investigating officer to proceed with the same. Needless to state that since the Staterespondents and the private respondents have not used any affidavit, the allegations and/or accusations made in the writ petition are deemed not to have been admitted.

With the aforesaid observations, the writ petition being WPA 5822 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
