Mukherjee ... for the State Mr. Noor Islam Seikh Mr. Shamik Bagchi Mr. Priyankar Bhowmick ... for the de facto complainant Learned counsel for the petitioners submits that the petitioners are the in-laws of the alleged victim. The marriage between the couple took place 11 years ago. The couple was residing at a separate place. On 31.10.2025, the alleged victim suddenly fell ill and was taken to the hospital where she subsequently passed away. There is no external injury, as would be evident from the post-mortem report. Learned counsel for the de facto complainant strongly opposes the prayer for anticipatory bail and submits that the couple and the parents-in-law were residing at the same premises, only in adjacent rooms. It is alleged that, for some time, they had been taking their meals separately.
Learned counsel for the State relies on the case diary and vehemently opposes the prayer for anticipatory bail. He also relies on the statements of witnesses including neighbours, who, according to him strongly support the prosecution case. He submits that although the post-mortem report did not throw any light on the cause of death, a subsequent opinion of the doctor states that the victim died due to effects of acid poisoning. After the incident, the petitioners along with the husband fled away and have remained absconding. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. The personal appearance of the investigating officer is noted and is dispensed with.
