akb Mr. Saibal Acharya Mr. Ambu Bindu Chakraborty ...For the Petitioner Ms. Chaitali Bhattacharya Mr. Kartik Chandra Kapas ...For State Respondents This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent No. 3, being the District Inspector of Schools (SE), South 24-Parganas, in releasing the outstanding due salaries of the petitioner for the period from February 7, 2020 to February 1, 2021 amounting to Rs. 7,04,327/-.

Learned Counsel appearing on behalf of the State respondents submits that as the post was not approved by the authorities concerned, salary of the petitioner is pending. He however submits that the District Inspector of Schools (SE), South 24-Parganas may be ordered to grant an opportunity of hearing and pass a reasoned order on the same after going through all the relevant documents.

Accordingly, the District Inspector of Schools (SE), South 24-Parganas, being the respondent No. 3 is directed to grant an opportunity of hearing to the petitioner and thereafter, pass necessary reasoned order on the same upon going through the relevant documents within a period of four weeks from the date of communication of this order. The reasoned order should be communicated to petitioner within a week from the date of passing such reasoned order.

With the aforesaid observation the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.
