None appears on behalf of either of the parties. This matter is pending in the list since 02.12.2022 and has been called on each day of working of this Court since that date. In spite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. In this revision the petitioner has challenged the criminal proceedings against him in G.R. Case No. 8633 of 2015 arising out of Golabari Police Station Case No. 1387 of 2015 under Section 420/120B of the Indian Penal Code. The G.R. Case no. 8633 of 2015 is now pending in the Court of Chief Judicial Magistrate at Howrah.

The petitioner is basically aggrieved of the fact that in spite of no cognizable case having been made out against him in the FIR, the Magistrate has taken cognizance and proceeds with the criminal case against him. On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 688 of 2016 is dismissed.
