And Allowed In Re : Tapas Goutam Kar ...... petitioner Mr. Soumik Ganguli Mr. Sayan Roy ...... for the petitioner Mr. Rana Mukherjee Mr. T K Ghosh Mr. Pratick Bose ...... for the State The application for anticipatory bail under section 438 Cr.P.C has been filed apprehending arrest in connection with Bankura Women P.S Case no. 17 of 2020 dated 3.3.2020 under sections 498A/323/406/34 of the IPC and under sections 3/4 of the Dowry Prohibition Act.

It is submitted on behalf of the petitioner although FIR has been filed, the petitioner has been co-operating with the investigation. Counsel for the State also submits that the petitioner has co-operated in the proceeding under section 41 A Cr.P.C.

Under such circumstances, this court is of the view that the petitioner is entitled to bail.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 25,000/- with two sureties of like amount each, to the satisfaction

of the Arresting Officer and also be subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.

In the event of violation of any of the condition of bail, the bail shall be treated as cancelled by the Trail Court without further reference to this Court.
