The petitioner adopts a rather peculiar stance before this Court to challenge a provisional order of assessment.

The petitioner contends that although he is not a consumer of WBSEDCL, he has been served with a provisional order of assessment on the allegation of hooking. A criminal case has also been lodged against him. The petitioner asserts that he is "Samit Sardar", son of Sailen Sardar, whereas WBSEDCL has proceeded against an individual named "Sumit Sardar", son of Sailen Sardar.

Learned counsel for WBSEDCL, however, submits that the proceedings were initiated against "Samit Sardar."

Learned counsel for WBSEDCL submits that a final order of assessment, dated March 18, 2025, was sought to be served upon the petitioner, but the petitioner refused to accept the service.

In light of the above, there is no further scope to pass any order in this writ petition. A copy of the final order of assessment has been provided to the learned counsel for the petitioner.

The petitioner is at liberty to challenge the final order in accordance with the law, if so advised. Accordingly, WPA 5972 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
