The petitioners had participated in the Teacher Eligibility Test (T.E.T.), 2014 conducted by the West Bengal Board of Primary Education but were unsuccessful.
The application of the petitioners under the Right to Information Act, 2005 to get their respective O.M.R. sheets of the said Test, was refused by the Exofficio SPIO, West Bengal Board of Primary Education.
The petitioners are now praying that their said respective original O.M.R. sheets be provided to them. Mr. Biswas, learned Advocate for the West Bengal Board of Primary Education submits that the Board, on September 14, 2016 had issued a notice bearing Memo. No. 2150/BPE/2016 : 166L/TET/2014 to all concerned notifying the publication of the result
of TET, 2014 as well as the resolution of the Board dated November 17, 2015 whereby the R.T.I.
applications in regard to the marks obtained and supply of photocopy of OMR/Digitized Data Sheet regarding the T.E.T., 2014 were invited for a period of 30 (thirty) working days from the date of publication of the results i.e. on and from September 15, 2016 to November 09, 2016 with a rider that no application beyond the said time would be entertained.
Mr. Biswas further submits that the petitioners admittedly did not respond to the said notification but have applied for the respective O.M.R. sheets only in the year 2023.
The petitioners' failure to respond to the said notification of the Board disentitles them to get the relief as prayed for, W.P.A. 6269 of 2024 is therefore dismissed without any order as to costs.
