Petitioner is aggrieved by the fact that in spite of informing the police authorities regarding the interference at the behest of the private respondents, the private respondents had been adamant and pursued their disturbance and obstruction in respect of peaceful enjoyment of property of the petitioner.

Records of the case reflect that TS 113 of 2012 was decreed by the learned Civil Judge (Junior Division), 2nd Court, Baruipur. The learned court was pleased to direct that there should not be any interference in respect of the cultivation of the petitioner.

Be that as it may, petitioner would be at liberty to approach the civil court for execution of the said decree. In case any directions are passed

upon the police authorities, police authorities would respect, obey and implement the order so passed by the civil court.

Since none appears on behalf of the State Ms. Barnali Gupta, learned advocate who ordinarily appears for the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

With the aforesaid observations WPA 5612 of 2022 is disposed of.
