Sushmita Sarkar Mondal, is personally present in court and has made her submissions.
She has submitted that she would contest the contempt proceeding on her own and would not take any legal assistance. However, considering the nature and gravity of the matter she is advised to take help of an advocate. She is entitled to free legal service.
She has also submitted that she wants to prefer a Special Leave Petition against our order. In the event the she makes a written request to the Secretary, High Court Legal Services Committee, the Secretary, High Court Legal Services Committee shall appoint a competent advocate to represent her in this proceeding free of cost.
The Secretary, High Court Legal Services Committee must ensure that a competent advocate is appointed to draft a Special Leave Petition at the earliest and ensure that the SLP is filed before the Hon'ble Supreme Court without delay.
However, in the event the respondent/contemnor does not approach the Secretary, High Court Legal Services Committee
in terms of this order, it shall be presumed that she does not require any legal assistance.
Registrar Administration (L & OM) is directed to communicate this order to the Secretary, High Court Legal Services Committee for information and doing the needful.
The matter stands adjourned for four weeks.
The pendency of the contempt application shall not prevent the contemnor to comply with our order.
The alleged contemnor shall file affidavit-inopposition within two weeks from date, reply, if any, be filed within one week thereafter.
