Learned advocate appearing for the petitioners submits that, the petitioners were falsely implicated. Learned Additional Public Prosecutor appearing for the State draws the attention of the Court to the materials in the case diary including the statement of the injured recorded under Section 161 of the Code of Criminal Procedure (Cr.P.C.) and the 164 Cr.P.C. statement of one injured.

There are materials in the case diary implicating the petitioners in the incident. The incident resulted in death of one person and atleast one other person being injured. Considering the gravity of the offence and the involvement of the petitioners therein, we are unable to grant anticipatory bail to the petitioners.

Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM (A) 1510 of 2022 is dismissed.
