Learned advocate appearing for the petitioner submits that, the other co-accuseds were enlarged on anticipatory bail by this Hon'ble Court. He submits that, the police filed chargesheet and, therefore, custodial interrogation of the petitioner is not required.

Learned Additional Public Prosecutor refers to the case diary and submits that the eye witness names the petitioner as the person dealing the fatal blow.

Considering the materials in the case diary, we are unable to arrive at a finding that the petitioner is standing on the same footing as that of the other co-accuseds granted anticipatory bail by this Hon'ble Court.

Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1511 of 2022 is dismissed.
