The petitioner has alleged unauthorised encroachment upon the PWD land being Dag No.1995 within Mouza-Puyada under Police Station-Nandakumar in the District of Purba Medinipur.

The petitioner claims to be the owner of L.R. Plot No.2021, 2022 and 2023. The petitioner alleges that the private respondent has encroached upon a portion of the PWD land being plot No.1995.

The learned advocate appearing for the private respondent submits that the petitioner and the private respondent are co-sharers in respect of the plot No.2023 and since the constructed portion of the private

respondent on plot No.2023 is situated in front of the constructions of the petitioner on the said plot, the petitioner has approached this Court with this writ petition.

After some argument, Mr. Bhattacharyya, learned advocate appearing for the petitioner prays for leave to withdraw this writ petition.

In the light of the submission made by Mr.

Bhattacharya, learned advocate for the petitioner, WPA 5998 of 2026 stands dismissed as withdrawn.

It is however, made clear that this order shall not prevent the petitioner from approaching the appropriate forum in accordance with law if any fresh cause of action arises.

There will be no order as to costs.
