Sarwar Jahan, Mr. Anusur Rahaman, Ms. Tapati Sarkar ....for the Petitioner Mr. Arindam Chattopadhyay, Ms. Lipika Chatterjee ....for the State Instructions given by the Superintendent of Police (Home Guards), Murshidabad Police District to the learned State advocate is placed before the Court, which is taken on record as the report filed by the Superintendent of Police (Home Guards), Murshidabad Police District.

On a perusal of the report, it is apparent that on 01.10.2019, the petitioner was acquitted of the criminal case wherein he was implicated. This date is prior to initiation of the selection process which took place by an advertisement dated 7th August, 2020. It is also apparent from the report that the entire selection process has been over and as such there is no vacancy left for accommodating the petitioner in the said selection process even if it is assumed without admitting

that the petitioner had qualified for the same. In any event the petitioner's serial number in the merit list as provided by the petitioner was 137. The vacancies got filled up much before the petitioner could be called. In the aforesaid facts and circumstances, the writ petition is disposed of without any further order. (Arindam Mukherjee, J.)
